ACH Responds to Revised Minnesota Statute

(Franklin, TN) — Advanced Correctional Healthcare, Inc. (ACH) announced today that revised language to Minnesota Statute 241.021 appears to address several of the most significant patient safety and clinical concerns identified by correctional healthcare providers, sheriffs, and counties across the state. As such, ACH has dismissed its lawsuit challenging the statute based upon the amendment.
ACH first raised concerns that the original statutory language could force clinicians to administer medications without adequate consideration of a patient’s current medical condition, potentially creating dangerous situations involving overdose risk, contraindications, pregnancy complications, intoxication, withdrawal, or rapidly changing psychiatric presentations. The updated statute language allows providers at the bedside to exercise their professional judgment and includes revised provisions that now require “reasonable efforts to consult” with an outside prescriber before medication changes are made, rather than broadly restricting the medical judgment of licensed correctional healthcare professionals.
